Originally derived from the Latin word situere, meaning "to offer for sale", prostitution describes the offering and provision of sexual services for profit. Pickles, (n.d.), further describes prostitution as the exercise of a trade or business by one person who submits to another for gain or compensation for the provision of sexual services. According to the Australian Institute of Family 2008, sex work is broadly defined as the exchange of sexual services (including oral sex, vaginal and anal sex, sexual contact, masturbation and massage) for payment or reward. There are different modes of sex work within the community, including street work, brothel work, private and escort work, as well as table dancing, all of which create different experiences of such sex work. Therefore, even those who regulate the sale of sex may be bound by legislation relating to prostitution. Despite being the "oldest prostitution", prostitution is still considered an "immoral" and "undesirable" service by various sectors of society (Pickles C, Nd). . Legislators have the “onerous task” of governing the inconsistent views of communities and so prostitution remains controversial in Australia, continuing to vex criminal justice authorities across the nation as in most other countries in the world (Australian Institute of Criminology, 1990, 1). . Confusion over the certainty of Australian laws regulating prostitution has long clouded both legislators and "sex industry" workers.
