According to the 1st Amendment, free speech protections of the homeless should not be penalized for panhandling. The 4th Amendment's protection from unreasonable searches and seizures would argue that law enforcement should not be allowed to seize and destroy the belongings of homeless people. The Eighth Amendment which protects citizenship, due process and equal protection would agree that not taking someone seriously who is the victim of a crime because they are homeless is a violation of their rights. People who already suffer are now being punished for their disadvantages and therefore face even more barriers. Criminalizing homelessness does nothing to address the problem of why people live on the streets, but simply to get rid of homeless people who are seen as an eyesore (Building a Movement to End Homelessness). For this situation to resolve itself, the root causes of why people are becoming homeless need to be addressed
