Plessy vs Ferguson is an excellent example of how one of the Human Rights has been violated and denied. The Plessy v. Ferguson case established that “racial segregation in public facilities is required under the separate but equal doctrine” (jstor.org). This case would violate Article 7 of the Universal Declaration of Human Rights which states that “all are equal before the law and are entitled, without discrimination, to equal protection of the law.” In our senses, we believe that how can such a simple and concise article govern such a drastic sentence. However, this rule remained in effect for sixty years before being overturned by Brown v. Board of Education. There were many reasons why the court ruled in favor of the racial segregation claim in Plessy v. Ferguson. One of the reasons the case ended up in court was because Louisiana had a law requiring separate railroad cars for whites and colored races. This all began on June 7, 1892 when Homer Plessy sat in an empty seat of an exclusively white car. This led to his arrest and he later argued that segregation violated the Fourteenth Amendment. The Fourteenth Amendment prohibits “denying to any person within your jurisdiction the equal protection of the laws.” After this initial court ruling it was determined that the Fourteenth Amendment was created for "the absolute equality of the two races before the law" (pbs.org). My feelings towards this case are: how can equality exist between two people, if everywhere and in everything? do they make it racially segregated? Since the court has established and permitted “racial segregation in public facilities,” how can two individuals ever be given the opportunity for equality? I'm not one to say that, because I didn't live during that time, but all I know......middle of paper......I don't think so, because of issues like racial segregation. Yet now, in modern America, I feel that the views and opinions that America's founding fathers had about this great land are true. People of any color and race can literally do whatever they want as long as it isn't illegal or intrudes on someone else's personality. In the future I can assume that the world will be more informed about social and racial claims; so there is nothing to worry about from today onwards. We will continue to live in a place that claims to be, and if any obstacles get in the way, they will be addressed appropriately. I can't assume what kind of way it would be; all I can say is that the world we live in is more about living a contented life and being happy. They would know how to address any racial or social wrongdoing.
