Mark Solomon is torn between hiring his church colleague and a hard-working individual who deserves a permanent position, or denying him the position based on falsified employment documents. The conflict in this case arises mainly from the conversation between Lupe Garza (Carmen Mendoza) and Sarah, the human resources staff. Sarah knowingly promised Lupe a permanent position at the plant. In doing so, Lupe turned down another job that was offered to her because of the promise Sarah had made to her. Mark Solomon, who knows Lupe Garza by her real identity, is troubled by the revelation that she had been working under a false identity and proceeds to widen the conflict. Although she is clearly qualified for the permanent position based on her immediate availability and skills, Mark disputes the legal implications of hiring her with her assumed identity. The further revelation that there were multiple Mexicans working at the plant under false identities does not help sway Mark in his decision making. The interested parties in this ethical dilemma are Lupe Garza, Sarah, and Mark Solomon. By knowingly hiring individuals with full knowledge of their purchased identities, the company was violating Code Section 1324a – Unlawful Employment of Aliens. In the first case, the employer, in this case the company, failed to make a good faith effort as required by verifying each employee's Social Security numbers from the administration's website. Mark, however, violated the law against continuing to hire a foreigner, even on a temporary basis, once it was established that Lupe Garza had a false citizenship....... middle of paper ......ards in by virtue of the position held in the company.
